{"id":1854,"date":"2015-01-02T17:50:23","date_gmt":"2015-01-02T15:50:23","guid":{"rendered":"https:\/\/www.women-in-exile.net\/?p=1854"},"modified":"2015-01-02T17:50:23","modified_gmt":"2015-01-02T15:50:23","slug":"changes-of-the-residenzpflicht-law","status":"publish","type":"post","link":"https:\/\/www.women-in-exile.net\/en\/austausch\/changes-of-the-residenzpflicht-law\/","title":{"rendered":"Changes of the &#8216;Residenzpflicht&#8217; law"},"content":{"rendered":"<p><a href=\"http:\/\/women-in-exile.net\/2015\/01\/02\/aenderungen-der-residenzpflicht\/\">Deutsch hier<\/a><\/p>\n<p><strong>The amended &#8216;Residenzpflicht&#8217; law came into force yesterday.<\/strong><\/p>\n<p><strong>The most important changes:<\/strong><br \/>\n<span style=\"text-decoration: underline\">For refugees with &#8216;Aufenthaltsgestattung&#8217;<\/span> the geographical<br \/>\nrestriction (restriction of movement) &#8220;expires&#8221; after three months of<br \/>\nstay.<br \/>\nAfter that they are allowed to move freely within the German territory without a permit.<br \/>\nThe obligation to reside in a particular place remains.<\/p>\n<p><strong>Unfortunately, there are many exceptions:<\/strong><\/p>\n<ol>\n<li>A final conviction because of a criminal offense (no minimum<br \/>\npenalty or limitation), if it is not because of a violation of<br \/>\nimmigrantion laws.<\/li>\n<li>Violation of the&#8221;Bet\u00e4ubungsmittelgesetz&#8221; (= drug possession), even if there was no conviction by a court.<\/li>\n<li>If &#8220;concrete measures to terminate residence&#8221;are imminent. But this should never! be the case with persons with &#8216;Aufenthaltsgestattung&#8217;.<\/li>\n<\/ol>\n<p>Refugees who fall within these exceptionsare, as usual, at the mercy<br \/>\nof the foreigners authorities.<\/p>\n<p><span style=\"text-decoration: underline\">For refugees with &#8216;Duldung&#8217;<\/span>, the geographical restriction (restriction of movement) &#8220;expires&#8221; after three months of stay as well.<br \/>\nAt least in theory: Lawyers fear that the claim of foreigners<br \/>\nauthorities that &#8220;concrete measures to terminate residence&#8221; are<br \/>\nimminent will enable the authorities to &#8220;tie&#8221; refugees arbitrarily to<br \/>\ncertain districts at any time &#8211; as before.<\/p>\n<p><strong>These things will stay as they were:<\/strong><\/p>\n<ul>\n<li>For asylum seekers in reception centers the stay will remain<br \/>\nrestricted tothe district of the foreigners authority. In<br \/>\nBrandenburgthis is the Municipality of Eisenh\u00fcttenstadt.<\/li>\n<li>The absurd and unique rule within the German legal system that violations of the geographical restriction are first considered an administrative offense and, in the event they are repeated, aiminal offense.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Deutsch hier The amended &#8216;Residenzpflicht&#8217; law came into force yesterday.
